Electric scooters and the Road Traffic Act
Amendments to the Motor Insurance Act on 1 June 2024
The government has made an amendment to the Motor Insurance Act, which is based on the EU Motor Insurance Directive. With this amendment, unregistered electric mobility devices, such as electric scooters, electric mopeds and electric scooters, must be insured if they exceed the speed, power or weight limits specified in the law. An electric scooter, electric moped or electric scooter in private use must be insured if it weighs more than 25 kg, has a top speed of more than 25 km/h or has a power of more than 1000 W. The amendment entered into force on 1 June 2024.
Previous insurance claim
According to the law updated in 2016, electric scooters and kickboards were classified as light electric vehicles. The maximum permitted speed of these vehicles was 25 km/h and the maximum permitted power was 1 kW. The requirements for light electric vehicles included a front light, an audible warning device, reflectors and the absence of a seat. These vehicles did not need to be insured unless they exceeded 25 km/h or 1 kW of power, in which case they were classified as non-light electric vehicles and had to be insured.
Changes after June 1, 2024
According to the new law, all vehicles weighing more than 25 kg and/or traveling at more than 25 km/h, with the exception of pedal-assist electric bicycles, must have motor vehicle insurance. This means that electric scooters, mopeds and kick scooters weighing more than 25 kg must also be insured, regardless of their power or top speed. After the change, electric vehicles weighing less than 25 kg but traveling at more than 25 km/h or with a power of more than 1 kW must still be insured, as before. The new requirement is that electric scooters and kick scooters weighing more than 25 kg must be insured, even if their top speed is no more than 25 km/h and their power is no more than 1 kW.
Electric scooters Motor vehicle insurance
Motor third party liability insurance is a statutory insurance that must be taken out for almost all vehicles. The driver of a privately owned electric scooter is compensated for all costs arising from personal injury, such as possible rehabilitation or disability. However, for someone riding an electric scooter from a rental company, motor third party liability insurance only covers medical expenses. Damage caused to third parties will be compensated regardless of who owns the electric scooter.
Road use of an electric vehicle
The owner or buyer of an electric scooter or electric kickboard must note that not all electric vehicles are suitable for road use. Vehicles that travel more than 25 km/h or have a power output of more than 1000 W may not be driven on the road without registration, even if they are covered by compulsory motor vehicle insurance.
Registration of scooters over 1000W
If you want to drive an electric scooter or moped with an engine power exceeding 1000 W or a top speed exceeding 25 km/h on the road, this is possible by registering and insuring the electric scooter. Before purchasing, make sure that the electric scooter in question has an EU road traffic COC certificate, which allows it to be used on public roads throughout the EU. An EEC certified electric scooter is supplied with an EU road traffic approval COC certificate, which allows the scooter to be registered and insured.
